Provisional Measure no. 870/2019 (available here)


Impact

Provisional Measure no. 870/2019 transferred the National Institute of Colonization and Agrarian Reform (INCRA) to the Ministry of Agriculture, Livestock and Supply (MAPA). The Measure also created, within the Ministry of Agriculture, a special secretariat for land issues within the Ministry of Agriculture. Bolsonaro appointed as head of this function Nabhan Garcia, former president of the Rural Democratic Union (UDR) and self-declared self-declared enemy of agrarian reform.


Also, the Ministerial reform of the Bolsonaro administration (MPV 870/2019) allows the dismantling and control by ruralists of environmental agencies, and the rights of indigenous and traditional populations. The Ministry of Environment (MMA) is stripped of its competencies and loses the ability to formulate and conduct some policies that are fundamental to the portfolio's historical (and logical) competencies. The Secretariat of Climate Change and Forests is extinguished, and the SFB (Brazilian Forest Service) and CAR (Rural Environmental Registry) are transferred to MAPA, while the National Water Agency (ANA) is transferred to the Ministry of Regional Development (MDR). FUNAI leaves the Ministry of Justice and Public Security (MJSP) and goes to the Ministry of Women, Family and Human Rights. The competence for the demarcation of indigenous lands, however, goes to MAPA.

Impact

Ricardo Salles asks the Office of the Comptroller General (CGU) to audit an Ibama car rental contract. The Minister criticized the contract and President Jair Bolsonaro corroborated the unfounded accusation, which was initially made through social networks. Such accusations led to the resignation of the then president of Ibama.

Impact

Ibama cancels the environmental fine imposed on Jair Bolsonaro for irregular fishing in Angra dos Reis, on the Green Coast, applied in 2012. The process had already been analyzed by the first and second instance judges of Ibama who had decided for the maintenance of the fine.

Impact

Chief of the Air Operations Center of Ibama's Environmental Protection Directorate, José Morelli, is exonerated. The server was responsible for an enforcement action executed on January 25, 2012 that fined Jair Bolsonaro R$ 10 thousand for illegal fishing in the ecological station of Tamoios (RJ).
